Elon Musk’s X Faces EU Privacy Complaints Over AI Data Usage

Elon Musk's social media platform, X, has recently come under scrutiny following a series of privacy complaints filed across multiple European Union (EU) countries. The controversy stems from the platform’s decision to process user data for training its Grok AI chatbot without obtaining explicit consent from users in the region. This practice has raised concerns among privacy advocates and regulators, leading to a flurry of legal challenges and regulatory scrutiny.

The Controversy

The issue came to light in late July when a social media user discovered a setting indicating that X had started using the data of EU users to train its AI models. The Irish Data Protection Commission (DPC), which is responsible for overseeing X's compliance with the EU's General Data Protection Regulation (GDPR), expressed "surprise" at the discovery. The GDPR mandates that any use of personal data must be based on a valid legal justification, and the absence of user consent in this case has been called into question.

The complaints, filed in nine EU countries including Ireland, Austria, Belgium, and France, argue that X’s actions violate the GDPR. The regulation allows for severe penalties, including fines of up to 4% of a company’s global annual turnover, for confirmed infringements. The complaints are supported by the privacy rights organization noyb, chaired by Max Schrems, who has been a prominent figure in the fight for digital privacy in Europe.

Legal Basis Under Scrutiny

At the heart of the dispute is whether X can legally justify its use of user data under the GDPR. X appears to be relying on the concept of “legitimate interest” to process the data without user consent. However, privacy experts and advocates argue that this is insufficient and that explicit user consent should have been obtained, especially given the sensitive nature of using personal data for AI training.

The GDPR is designed to protect individuals from unexpected and potentially harmful uses of their personal information. In this case, users of X were not made aware that their data was being used for AI model training, making it impossible for them to exercise their rights under the regulation, such as opting out or requesting the deletion of their data.

Noyb’s Involvement

Noyb, the privacy advocacy group supporting the complaints, has been critical of the DPC’s response to the situation. Schrems, in a statement, pointed out the inefficiencies and partial enforcement by the DPC in the past and emphasized the need for stronger actions to ensure X complies with EU law. Noyb has also taken legal action in the Irish High Court, seeking an injunction to stop X from continuing its data processing activities without proper consent.

The group has drawn parallels between this case and a previous legal battle involving Meta, where the European Court of Justice ruled that legitimate interest was not a valid legal basis for processing user data for ad targeting. Noyb argues that the same logic should apply to X’s use of data for AI training.

Regulatory Response and Potential Impact

The DPC has acknowledged that X was processing EU users' data for AI training between May 7 and August 1. Although X introduced an option for users to opt out of this processing in late July, the setting was only available on the web version of the platform, and many users were unaware that their data was being used in this manner.

The case highlights broader concerns about the use of personal data in the development of AI systems. Generative AI providers, including X, often struggle to comply with core GDPR requirements, such as the right to be forgotten and the right to access one’s data. These challenges are not unique to X, as similar issues have arisen with other AI platforms like OpenAI’s ChatGPT.
